A new or replacement driveway is one of the more visible changes you can make to a York property, and it's also one of the few pieces of garden landscaping with a specific, well-defined planning rule attached to it, worth understanding before committing to a design.
RW Builders builds driveways for homeowners across York and North Yorkshire, in a range of materials and finishes.
Since 2008, a specific rule has applied to front garden driveways in England:
This rule exists because of the cumulative effect of front gardens across a whole area being paved over with impermeable surfaces, increasing surface water runoff into public drains and contributing to local flood risk. It's not simply a bureaucratic hurdle, it reflects a genuine drainage consideration, which is why using permeable materials or proper drainage isn't just a way around the rule, it's genuinely the better approach for managing rainwater on your own property.
If a new or replacement driveway covers more than 5 square metres and uses an impermeable surface (such as standard block paving, tarmac or poured concrete) that doesn't allow water to drain away naturally, planning permission is required
This requirement is avoided entirely if the driveway uses a permeable or porous surface, such as gravel, permeable block paving or porous asphalt, allowing rainwater to drain through into the ground below
It's also avoided if an impermeable surface directs rainwater to a lawn, border, or soakaway within the property rather than out towards the road
Areas under 5 square metres aren't affected by this rule regardless of surface type

Unlike a garden patio, a driveway needs to support the ongoing weight of vehicles, which means the sub-base construction generally needs to be deeper and more robustly compacted than paving intended only for foot traffic. Getting this wrong is a common cause of driveways that look fine when finished but start rutting, sinking or cracking within a couple of years of regular vehicle use. We size the sub-base to the specific vehicles using the driveway rather than applying a generic specification regardless of use.
Permeable block paving – looks similar to standard block paving but allows water to drain through gaps or the material itself, avoiding the planning requirement regardless of size
Gravel – naturally permeable, relatively low-cost, and gives a traditional appearance particularly suited to period properties
Porous asphalt or resin-bound surfacing – a more contemporary permeable option with a smoother finish than gravel
Standard block paving, tarmac or concrete – impermeable options that look and perform well, but need to either stay under 5 square metres or direct water away from the road to avoid needing planning permission
Excavation to the required depth for the chosen surface and expected vehicle loading
A properly compacted sub-base, sized for the weight of vehicles using it
Edging to contain the surface material and give a clean finished edge
The chosen surface material laid and compacted or bedded correctly
Drainage considered from the design stage, whether that's permeable surfacing or a dedicated drainage channel and soakaway
We're a family-run team based in York, and we'll advise honestly on whether your driveway design needs planning permission before you commit to a material, rather than leaving you to find out after the work is done. We work across the city and surrounding villages including Haxby, Strensall, Poppleton and Wetherby, and every quote is clear and written with no hidden extras.
Excellent job from Phil and his team. Both external and internal works finished to an excellent quality. Happy to deal with changes and kept us informed on a day-to-day basis. Definitely recommend.
